Terms of Service

By creating an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

If you use the Service for an organisation, you confirm you can bind that organisation to these Terms, and "you" includes it.

You must be at least 16 years old to use the Service.

Give accurate details when you sign up and keep them current. Keep your password and sign-in tokens secure. You are responsible for everything that happens under your account. One person per account: don't share, sell or transfer it.

Tell us straight away if you think your account has been accessed without your permission.

Bana Video is a video editor with an AI copilot. Some features, such as Showrunner, transcription and generation, send your content to servers run by us or by AI model providers in order to work.

AI features can be wrong, incomplete or unexpected. Review what they produce before you rely on it or publish it.

We are constantly improving Bana Video. We may add, change or remove features, AI models, themes, templates, integrations, usage limits and plans at any time, and we may suspend or discontinue the Service or any part of it.

Where a change materially reduces what a paid plan includes, we'll give you reasonable notice. You can cancel before it takes effect.

Bana Video has a free plan and paid plans (currently Starter, Creator and Studio). Paid plans are billed in advance and renew automatically each billing period until you cancel.

You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.

Payments are non-refundable. We don't give refunds or credits for partial billing periods, unused time, downgrades or unused generation credit.

Generation credit has no cash value and can't be transferred. Monthly credit expires at the end of the period it's issued for, and all credit expires when your plan ends, unless we say otherwise when you buy it.

We may change our prices. We'll tell you at least 30 days before a new price applies to your subscription. It takes effect at your next renewal after that notice. If you don't agree, cancel before then; continuing your subscription means you accept the new price.

Prices are shown in US dollars and exclude taxes such as GST, which we add where the law requires.

Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, or similar laws where you live, that can't be excluded. If you are acquiring the Service for the purposes of a business, the Consumer Guarantees Act 1993 does not apply, and you agree that it is fair and reasonable for the parties to be bound by this.

You own what you bring to Bana Video and what you make with it: your uploads, projects, edits, prompts and generated outputs ("Your Content"), to the extent the law allows them to be owned.

You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display Your Content as needed to run, secure and support the Service for you.

You also allow us to use Your Content to train, evaluate and improve our models and features. You can opt out at any time in your account settings or by emailing us; after that we won't use content you create from then on for training.

You are responsible for Your Content. You confirm you have the rights you need for everything you upload, including music, footage, likenesses and voices of real people.

Generated outputs may not be unique, and other users may receive similar results. We don't promise that outputs can be protected by copyright or are free of third-party rights.

Generation uses third-party models, and their usage policies apply too. Don't use the Service to create misleading content depicting real people without their consent, or content that breaks the law.

The Service lets you find and import photos, videos, sound effects and music from third-party libraries such as Pixabay, Pexels, Unsplash and music libraries ("Stock Media"). We don't own Stock Media. Each item stays under the licence of the library it came from, which the app links to, and you must follow that licence.

Stock Media is provided for digital creative projects: the videos and other content you make in Bana Video. Unless the item's own licence clearly allows it, you may not:

• sell or distribute Stock Media on its own or unaltered, including as stock files, wallpapers, templates or in another media library;
• put unaltered Stock Media on physical goods for sale, such as printing a stock photo onto mugs, t-shirts, posters, prints or cards;
• use it in a trade mark, logo or brand identity; or
• suggest that a person, brand or place shown in it endorses you or your content.

Attribution (CC BY). Some sounds and music are licensed under Creative Commons Attribution (CC BY). When you publish or distribute a video that uses one, you must credit it as the licence requires: the title, the creator, the licence name and a link to it, in your video's description, credits or wherever credits are reasonably expected. The app saves each credit with the file and has a Copy credit button. CC0 and similar items need no credit, though one is always appreciated.

Licences are set by the libraries and their contributors and can change. We pass them on as we receive them and don't guarantee that any item is free of third-party rights, such as trade marks, artwork or people's likenesses, so check items you rely on for commercial work.

You may publish, distribute, broadcast and monetise the videos you export from Bana Video, commercially or not, anywhere you like, as long as you follow these Terms and the licences of any Stock Media or third-party content in them.

Bana Video's own assets that you use inside a project, such as templates, titles, transitions, effects, sound effects and bundled fonts, are licensed to you for use within the content you make with the Service. That licence is non-exclusive and continues for content you have already published if your account ends. It does not let you extract these assets and use, sell or share them on their own, or in another editor, template pack or asset library.

Don't use the Service to break the law, infringe anyone's rights, or create or share sexual content involving minors, harassment, hate, malware or spam.

Don't interfere with the Service: no probing or bypassing security, overloading our systems, scraping, automated account creation, abusing free credit or limits, or reselling access.

The Service, including the app, website, Showrunner, themes, templates, effects, fonts we license, interface designs, documentation, code, the Bana Video name and logo, and every update to them, is owned by Bana Video Limited or our licensors and is protected by copyright, trade mark and other laws.

We grant you a personal, revocable, non-exclusive, non-transferable licence to use the Service under these Terms. That is the only right you get. © Bana Video Limited. All rights reserved.

You may not, and may not help anyone else to:

• copy, clone, imitate or recreate the Service, its look and feel, its features or its workflows, or make, distribute or sell a product that is substantially similar to it or derived from it;
• reverse engineer, decompile, disassemble or try to extract source code, models, model weights, system prompts or other non-public parts of the Service, except where the law expressly allows it;
• use the Service, its outputs or our content to build, train or benchmark a competing product;
• modify, rent, lend, sell, sublicense or redistribute the app, or remove any copyright, trade mark or other notice; or
• frame, mirror or republish any part of the website or the Service.

No redistribution licence. We don't grant anyone the right to redistribute the Bana Video app, its installer, its updates, the website or any of their content, whether free or paid, modified or unmodified, alone or bundled with other software. Get the app only from our website or official release channels, and link to them rather than re-hosting our files.

The Service connects to third parties, such as Google sign-in, stock media libraries, AI model providers and MCP clients. Their own terms govern your use of them, and we aren't responsible for them.

You can stop using the Service and delete your account at any time.

We may suspend or close your account if you break these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable we'll give you notice first. If we discontinue the Service entirely for reasons other than your breach, we'll refund any prepaid fees for the period after it ends.

The sections on Your Content, intellectual property, copying, disclaimers, liability, indemnity and governing law survive termination.

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind. We don't promise it will be uninterrupted, error-free or that your content will never be lost. Keep your own backups.

To the extent the law allows, we won't be liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

You agree to cover our losses and costs (including reasonable legal costs) from claims by others arising from Your Content or your breach of these Terms.

We may update these Terms. For material changes we'll tell you by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms.

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction, unless the law where you live gives you the right to bring a claim there.

If any part of these Terms can't be enforced, the rest still applies. Our not enforcing a term isn't a waiver of it. You may not transfer these Terms; we may transfer them as part of a sale or reorganisation of our business.
